Terms and Conditions 

Please have a read of these Ts & Cs. Reading them means you know what's up and you're cool with it (bound by it).

Booking
Payment can be made via this website, the B sport app, ClassPass, and bank transfers for parties. Please email any booking questions to studio@kelechnekoff.com.
Bookings for parties/corporate events will only be confirmed by email once a deposit has been paid.

Need to miss a class
If you can’t make a class, that's totally fine! Just drop an email to studio@kelechnekoff.com at least 12 hours in advance otherwise, that missed class credit will be forfeited.

Refunds & Cancellations
If you'd like a refund a full 7 days notice must be given prior to the chosen class and 14 days for a party/corporate event. For parties/corporate events, the deposit is non-refundable.

5 Class Pass
A 5 class pass can be purchased for £84, this pass entitles you to 5 classes and must be used within 4 weeks from the date of purchase. This pass is non-refundable once one class has been used. If the passes aren't used in time the pass can be extended by 3 months for £20.

Parties/Corporate events with Kelechnekoff
To book a party,  a non-refundable £70 deposit is required. The remainder is due 48 hours before the date of your event. If the balance isn’t paid by this time Kelechnekoff reserves the right to cancel your event, without refunding the deposit.

For corporate events, the rates are discussed based on the nature of the event. An agreement must be signed by both Kelechnekoff and the organiser to confirm invoicing details and the scope of the event.

If a party/corporate event is booked less than 2 weeks prior to the event, payment must be made in full at the time of booking.

No alcohol may be consumed at the venues sourced by Kelechnekoff.  Anyone known to be intoxicated at the time of the party/event will not be allowed to participate and no refund will be issued.

Please note once the deposit has been received:

• It is NON-REFUNDABLE in the event of cancellation by the party booker

• In the event of a request to reschedule made by the party booker less than 2 weeks prior to the agreed party date, the deposit will be forfeited and another £70 will need to be made in order to secure a new date/time.

  
  

Covid-19 Guidance
If somebody you live with or have recently come into close contact with, tests positive for Covid-19, you cannot attend the studio for 10 days even if your LFT comes back negative. We also recommend that you take a PCR test as soon as possible, and do not attend the studio until your result comes back negative. If you have to miss a class with less than 12 hours’ notice for Covid-related reasons, please send an email to studio@kelechnekoff.com letting us know. We will ensure your credits for any classes missed are returned to your Bsport account for use later.

Changes
Kelechnekoff reserves the right to make alterations to classes booked. This rarely happens, but sometimes it might be necessary due to circumstances beyond our control. This applies to start dates, times, venue locations for classes, workshops and private parties. If a change has to occur, Kelechnekoff will offer an appropriate alternative. If however none of the alternatives are convenient, you are entitled to a full refund.

Age Limit
All participants in Kelechnekoff workshops and classes must be over 18. Younger guests are welcome if accompanied by a parent or guardian. However, this at Kelechnekoff's discretion and we reserve the right to refuse an individual taking part if they are under 18.

Health and Safety
Before taking part in any physical activity with Kelechnekoff all participants are required to sign a waiver. If you have any reservations regarding your health or know that you are pregnant, please inform Kelechnekoff and we will be happy to discuss other class options.

For Pole fitness classes, clients must wear shorts in order to participate and clients must not wear skin moisturiser 24 hours prior to the class.

Lateness will result in non-participation by the latecomer, and no refund will be given.

Kelechnekoff is fully insured and first aid qualified.  Any failure to follow the instructions provided that results in personal injury will automatically mean clients are exempt from any type of insurance covered by Kelechnekoff.

Kelechnekoff reserves the right to alter these Terms & Conditions.

Lost Property
Any lost property will be stored at reception for 2 months before being donated/disposed of.

Filming and Photography
We often film and photograph classes and parties for use on our website and social media platforms, and our ClassPass profile.
If you wish to opt out or withdraw consent of your images and videos being used, please email studio@kelechnekoff.com with details of which images or videos you do not wish to be used, or wish to be removed from any of our platforms and these will be removed immediately.

Personal information

INFORMATION WE COLLECT
When you create an account with us via B Sport, we collect the necessary information,
voluntarily provided by you to enable you to sign up
for sessions on your own, and for us to track your membership/set up any
necessary Autopay systems for ease of use. Information we collect may
include but not be limited to First Name, Last name, email address, Credit
card details (including Number, expiry, and billing address), home address,
and who recommended the studio.

OTHER INFORMATION:
• Data We Collect Automatically:
The only information that we will collect
from you during your time training with us is your spending and
attendance to classes.

•We will also add you to the relevant
mailing list. We will only carry over your First Name, Last
Name and Email address in this process.

• We may use third-party website analytic tools such as Google Analytics
on our website that employ cookies to collect certain information
concerning your use of our Services. However, you can disable cookies
by changing your browser settings. Further information about the
procedure to follow in order to disable cookies can be found on your
Internet browser provider's website via your help screen.

• Advertisements:
You may see our Service advertised on other applications
or websites. After clicking on one of these advertisements and creating an
account on B sport with us you will become a user of the Service.
Advertising platforms, which include Twitter, Instagram and Facebook may
collect information for optimising advertising campaigns outside of the
Service.

• If you do not wish to receive personalised advertising that is delivered by
third parties outside of our own service, you may be able to exercise that
choice through opt-out programs that are administered by third parties,
including the Network Advertising Initiative (NAI), the Digital Advertising
Alliance (DAA).

WHERE INFORMATION IS PROCESSED
Kelechnekoff is located in the United Kingdom, however, your
information is housed with B sport. No matter where
you are located, you consent to the processing and transferring of your
information in and to the U.S. and other countries where the server hosts this
data. The laws of the U.S. and other countries governing data collection and
use may not be as comprehensive or protective as the laws of the country
where you live.

OUR USE OF YOUR INFORMATION
We use the information you provide in a manner that is consistent with this
Privacy Policy. If you provide information for a certain reason, we may use the
information in connection with the reason for which it was provided. For
instance, if you contact us by email, we will use the information you provide to
answer your question or resolve your problem. Also, if you provide
information in order to obtain access to our services, we will use your
information to provide you with access to such services and to monitor your
use of such services. Kelechnekoff may use this information to
contact you in the future to tell you about services we believe will be of
interest to you. This includes the adding of your name and email address
ONLY to MailChimp ‘lists’ who we use for all marketing send-outs. If we do so,
each marketing communication we send you will contain instructions
permitting you to "opt-out" of receiving future marketing communications. In
addition, if at any time you wish not to receive any future marketing
communications or you wish to have your name deleted from our mailing lists,
please contact us as indicated below.

OUR LEGAL BASES FOR HANDLING OF YOUR PERSONAL DATA
The laws in some jurisdictions require companies to tell you about the legal
the ground they rely on to use or disclose your personal data. To the extent those
laws apply, our legal grounds are as follows:

• To honour our contractual commitments to you: Much of our processing of
personal data is to meet our contractual obligations to our users or to take
steps at users’ request in anticipation of entering into a contract with them.
For example, we handle personal data on this basis to create your
account and provide our Services.

ground that it furthers our legitimate interests in ways that are not
overridden by the interests or fundamental rights and freedoms of the
affected individuals, this includes:
o Providing a safe and enjoyable studio experience;
o Customer service;
o Marketing, e.g. sending emails or other communications to let you know
about new features;
o Protecting our users and their property;
o Analysing and improving our business, e.g. collecting information about
how you use our Services to optimise the design of our product offering
o Managing legal issues

• Legal compliance:
We need to use and disclose personal data in certain
ways to comply with our legal obligations.

• To protect the vital interests of the individual or others:
For example, we may collect or share personal data to help resolve an urgent medical
situation.
• Consent: Where required by law, and in some other cases, we handle
personal data on the basis of your implied or express consent.

OUR DISCLOSURE OF YOUR INFORMATION
Kelechnekoff will NEVER sell your information. We
consider this information to be a vital part of our relationship with you. If at
any point we decide to work with 3rd party operators in an effort to improve
your experience with us, or provide additional perks/benefits for you, we will always allow you to opt-in for this service voluntarily,
and not force you to provide information to another company unwillingly.
• Consent: We may transfer your information with your consent.
• Agents, Consultants and Related Third Parties: Like many businesses, we
sometimes hire other companies or individuals to perform
business-related functions. Examples of such functions include mailing
information, maintaining databases and processing payments.
• Legal Requirements: We may disclose your information if required to do so
by law or in the good faith belief that such action is necessary to (i)
comply with a legal obligation, (ii) protect and defend the rights or
property of Kelechnekoff  (iii) protect the personal safety of
users of the Services or the public, or (iv) protect against legal liability.

UNSOLICITED INFORMATION
You may provide us with ideas for new products/services or modifications to
existing products/services, and other unsolicited submissions (collectively,
“Unsolicited Information”). All Unsolicited Information shall be deemed to be
non-confidential and we shall be free to reproduce, use, disclose, and
distribute such Unsolicited Information to others without limitation or
attribution.

CHILDREN
We intend on teaching classes to children in the future and we will not knowingly collect personal
information from children under the age of 13. If you are a parent or guardian
of a child under the age of 13 and believe he or she has disclosed personal
information to us please contact us at info@kelechnkeoff.com. For residents of
the EEA, where the processing of personal information is based on consent,
Kelechnekoff will not knowingly engage in that processing for
users under the age of consent established by applicable data protection
law. If we learn that we are engaged in that processing with such users, we
will halt such processing and will take reasonable measures to promptly
remove applicable information from our records.

LINKS TO OTHER WEBSITES
This Privacy Policy applies only to our services. Our website or Phone
Application may contain links to other websites not operated or controlled by
us. The policies and procedures we described here do not apply to the Third
Party Sites. The links from the Services do not imply that we endorse or have
reviewed the Third-Party Sites. We suggest contacting those sites directly for
information on their privacy policies.

DATA RETENTION
We generally retain personal data for so long as it may be relevant to the
purposes identified herein. To dispose of personal data, we may anonymize
it, delete it or take other appropriate steps. Data may persist in copies made
for backup and business continuity purposes for additional time.
